CONDITIONS<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>No variation of these terms and conditions shall be binding unless communicated in writing by FLAME OF AFRICA<\/td>\r\n<\/tr>\r\n<tr>\r\n<td><\/td>\r\n<\/tr>\r\n<tr>\r\n<td><strong>DURATION<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>The agreement validity is as stated on the rate sheet and it supersedes any previous agreement.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td><strong>BREACH<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>10.1 Should ANY of these terms and conditions itemized above not be fully complied with, FLAME OF AFRICA reserves<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>the right to:<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>i)\u00a0\u00a0 Cancel reservations.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>ii)\u00a0 Withdraw rates.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>iii)\u00a0 Withdraw any other special trading arrangements.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>iv)\u00a0 Terminate the contract.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>v)\u00a0\u00a0 Take legal action as necessary.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td><\/td>\r\n<\/tr>\r\n<tr>\r\n<td><strong>TERMINATION<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>FLAME OF AFRICA reserves the right to terminate this agreement by giving the agent one months' notice.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td><\/td>\r\n<\/tr>\r\n<tr>\r\n<td><strong>LEGALITY<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>This agreement is non-assignable and shall be constructed and have effect according to the laws of South Africa.<\/td>\r\n<\/tr>\r\n<tr>\r\n<td><\/td>\r\n<\/tr>\r\n<tr>\r\n<td><strong>FORCE MAJEURE<\/strong><\/td>\r\n<\/tr>\r\n<tr>\r\n<td>FLAME OF AFRICA shall not be obliged to perform any obligation under the Contract if such performance is rendered impossible, substantially more difficult or delayed as a result of Acts, Orders or Regulations issued by Central or Local Government, industrial disputes (whether official or unofficial), war, riots, hostilities, flood, fire, accident, act of God, epidemic, failure or shortage of supplies or from any other cause, event or occurrence which FLAME OF AFRICA is either unable to prevent having due regard to its interests. FLAME OF AFRICA shall not be liable for any loss, damage, cost or delay arising from or as a result of such non-performance.
